Effective Date: March 25, 2026  |  Last Updated: March 25, 2026

IMPORTANT NOTICE: These Terms and Conditions are provided as a general template for informational purposes only. They do not constitute legal advice. You should have this document reviewed by a qualified attorney to ensure it accurately reflects your business practices and complies with all applicable laws and regulations, including those specific to telehealth services in your jurisdiction.

1. Acceptance of Terms

5. Telehealth Services and Medical Disclaimer

5.1 Nature of Telehealth

Telehealth involves the delivery of healthcare services through electronic communications. While telehealth can be a convenient and effective means of receiving certain types of care, it has limitations. Not all medical conditions can be properly diagnosed or treated via telehealth, and providers may determine that an in-person visit is necessary.

5.2 No Doctor-Patient Relationship Guaranteed

Use of our platform does not guarantee the establishment of a doctor-patient relationship. A provider-patient relationship is only formed when a licensed healthcare provider explicitly agrees to provide you with care through our platform.

5.3 Not a Substitute for Emergency Care

Our Services are not a substitute for emergency medical care. Do not use our platform to seek help for medical emergencies, life-threatening conditions, or situations requiring immediate in-person attention.

5.4 Provider Independence

Healthcare providers accessible through our platform are independent professionals. We do not practice medicine, provide medical advice, or control the clinical decisions of healthcare providers.

6. User Conduct

When using our Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Provide false, inaccurate, or misleading information about yourself or your health
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to any part of our platform or systems
  • Transmit any harmful, offensive, harassing, or otherwise objectionable content
  • Interfere with or disrupt the integrity or performance of our Services
  • Use automated means (bots, scrapers, etc.) to access or collect data from our platform
  • Violate any applicable local, state, national, or international law or regulation

7. Payments and Billing

7.1 Fees

Certain Services may require payment of fees. All applicable fees will be disclosed before you complete a transaction. We reserve the right to change our fees at any time with reasonable notice.

7.2 Payment Processing

Payments are processed by third-party payment processors. By providing your payment information, you authorize us (or our payment processor) to charge all applicable fees to your payment method.

7.3 Insurance

We may facilitate the submission of insurance claims on your behalf; however, we do not guarantee coverage or reimbursement. You are ultimately responsible for any amounts not covered by your insurer.

7.4 Refunds

Refund eligibility is determined on a case-by-case basis. Please contact us at the information in Section 14 to request a refund. We are not obligated to provide refunds for completed consultations.

8. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of SecureTelehealth.com or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or exploit any content from our platform without our prior written consent.

9. Privacy

Your use of our Services is also governed by our Privacy Policy, available at www.securetelehealth.com/privacy . By using our Services, you consent to the collection and use of your information as described in that policy. Our Privacy Policy is incorporated into these Terms by reference.

10. Third-Party Links and Services

Our platform may contain links to third-party websites or integrate with third-party services. We do not endorse or control those third parties and are not responsible for their content, practices, or policies. Accessing any third-party services is at your own risk.

11. Disclaimers of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no warranty that the information on our platform is accurate, complete, reliable, or suitable for any particular purpose. Healthcare information provided through our platform is for general informational purposes and does not constitute medical advice.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SECURETELEHEALTH.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES.

In no event shall our total aggregate liability to you exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00 USD).

13. Indemnification

You agree to indemnify, defend, and hold harmless SecureTelehealth.com and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

You may discontinue your use of our Services at any time by deactivating your account and ceasing use of the platform.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law provisions. [Consult your attorney to confirm the appropriate jurisdiction for your business.]

15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of our Services shall first be subject to informal negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive the right to participate in a class action lawsuit or class-wide arbitration.

16. Entire Agreement and Severability

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SecureTelehealth.com with respect to your use of our Services and supersede all prior agreements.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
